TranslatorsCafe.com (TC, “we” or “us”) is an online platform for professional translators and other professionals who are interested in linguistics and engineering (the Unit Converter part of the website) provided by ANVICA Software Development. Our registered users called “Members” use our services to find business and career opportunities and to connect with other professionals and potential clients. This policy applies to any person who is visiting the TC website. TranslatorsCafe.com registered users share their professional identities with other people, post and view relevant content, learn from others, exchange their experience. Some content and data of our services are available to non-members called “Visitors” In this document, we address users collectively or individually as “Members”, “Visitors”, “you”, “user” or “users”.

TranslatorsCafe.com collects retains and processes all collected information on their servers located only in Canada and on terms of the Canadian Federal Personal Information Protection and Electronic Document Act (PIPEDA). For Members and Visitors residing in the European Economic Area, we also adhere to the requirements of the General Data Protection Regulation (GDPR). By providing any personal data on the TC website, you express your consent to such transfer of your data to Canada. Your public data may be accessed by TC advertising partners.

The terms “controller”, “personal data”, “processor” and “processing”, which are used in this document, have the meanings given in the GDPR.

This privacy policy applies to TranslatorsCafe.com, TermsCafe.com TC Hall of Fame and Shame (the HFS), TC Forums, TC Unit Converter and other services provided by TranslatorsCafe.com website (“Services”).

If you reside in the European Economic Area (EEA), which comprises the EU Members States and Iceland, Liechtenstein and Norway, ANVICA Software Development will be the controller of your personal data collected in connection with TranslatorCafe.com services and you are entering into the User Agreement with ANVICA Software Development. If you reside in the European Economic Area (EEA), ANVICA Software Development will be the processor of your personal data collected in connection with TranslatorCafe.com services and you are entering into the User Agreement with ANVICA Software Development. We use Google Analytics and Google AdSense services and Google also operates as a processor of your personal data. Use of Google services is subject to the Google Privacy Policy. Every time someone is served with a Google ad on a page containing, for example, your name in the search results, this page is scanned by Google bot and processed by a Google service. If you are under 16 years of age, please do not use or access our Services. Persons who are under 16 years of age are not eligible to use our services and we require that no private information about such persons be submitted to us. If we learn that persons under 16 years of age submitted their personal information, we will delete it. If you are the parent or guardian of a child under 16 years of age who uses TranslatorsCafe.com, then please contact us to have their information deleted.

TranslatorsCafe.com values the privacy of its users. This Privacy Policy explains how TranslatorsCafe.com collects and uses information through the TranslatorsCafe.com website. Data within TranslatorsCafe.com has been voluntarily provided by Members who have the ability to control access to it via various privacy settings in their profiles. By using this website, you expressly consent to the processing of information as described in this Privacy Policy. If you do not agree with this document, please do not use the TranslatorsCafe.com website.

If TranslatorsCafe.com makes a change to this Privacy Policy that we consider material, we will notify you through our Services or send you an email notification to provide you the opportunity to review the changes and to close your account in case of your objection to any changes. By continuing to use our Services after the changes become effective, you agree to be bound by the changed Privacy Policy.

To create an account, you need to provide personal data including your name, email address, ZIP code and a password. If you want to upgrade your membership, you will need to provide payment and billing information to the credit card processor (e.g. PayPal or Skrill).

If a Visitor files a support request, we ask for their email address and name, which will be used to address the Visitor and to send them a notification about our reply.

TranslatorsCafe.com is a business site, therefore we encourage you to provide your business name or real name if you use it for freelancing. However, if you are uncomfortable with this and if you think that others will be willing to do business with a person without a name or address and phone number, you can provide an alias.

You can provide any relevant information on your profile including your name, telephone number, education, work experience, skills, photo or logo, your postal address used in your business and other personal information. Your full profile helps you to fully use our Services. This helps potential clients to find you. Please do not include such sensitive data as your age or date of birth, race, ethnicity, political opinions, health, social insurance number, sexual orientation, criminal record, etc., that you would not want to be publicly available. If you chose to post such data, please understand that your profile is visible to others and search engines and we do not need this data and did not ask you for it. When you are sending your CV/résumé and cover letter to any third parties, your submissions will be subject to their privacy policies. In this case, your résumé and cover letter are outside the TranslatorsCafé.com website and our control. Although we use every reasonable means to protect your personal information, we are not responsible for any improper use of your personal information once it is publicly available and beyond the control of TranslatorsCafé.com. Please note that we do not sell or give your personal information contained in your private profile to anyone at any time. At the same time, if your profile is public, we are not responsible for the personal information because the available information that you voluntarily choose to display becomes publicly available and may be read and used by others without any restriction. We are not responsible for the personal information that you choose to make public.

Your email address is not visible and can be revealed only if you send a message to someone using the TranslatorsCafe.com mailing system. Your TranslatorsCafe.com profile is fully visible to all TranslatorsCafe.com members and visitors who are mostly your colleagues or potential clients with some exceptions:

• Your contact information that you have provided in the Contact Information section of your profile is visible if you checked the Display your contact information check box.
• If you select the Make all your information private check box, your profile will not be shown to the site users and search engines. Your name will not appear in the search results. However, your name will always be shown if you decide to post messages in TranslatorsCafe.com forums or ask questions in TCTerms. Another exception is job posting. If you consider posting a job on the Job Board, your profile will be accessible from the Selected Job page to members having a full profile.

You can control what appears on your profile page using the General tab of your profile. If your profile is not private, it may be visible not only to human visitors, but also to search engines like Google and Bing. If you do not want your profile to be visible, please make it private.

If you post your CV/resume on TranslatorsCafe.com, please note that although we expressly prohibit the scraping of the website, any CV/resume you post publicly is public information and the content may be copied by a third party in violation of these terms.

You can create your translation agency profile, which contains business information about your agency including its name, mailing address, description, telephone number, website, email address and personal contacts. This information is not considered private and you cannot control its availability. If you think it contains your private information, for example, if your agency is registered at your home address or contains your name, and you do not want it to be publicly available, please do not create this profile because it will be publicly available and you will not be able to make it private.

Information from your agency profile can be included into an Agency List in the form of a CSV file that can be downloaded by paying Members. If you do not want your email address to be included in this list, you can click the Disable Mail button on the Agency Profile page.

TranslatorsCafe.com collects personal data from you when you post it (on the profile form) or upload it (your CV/Resume) on our website. When you post any message in our Forums, TCTerms Questions and Answers or on the Job Board, it is visible even if you make your profile private.

You do not have to post or upload your personal information; however, if you do not, it will definitely limit your ability to engage with your colleagues and clients.

You are responsible for your posts and other information you provide through our services.

Please think carefully about what you make public, especially if it is sensitive information. Information that you post in our Forums and TCTerms instantly becomes public and can be copied on other websites and on search engines within minutes after posting.

When you communicate with other Members and Visitors or they communicate with you through our mailing system or private messaging system, we collect information about this communication. We automatically check the text of your messages to prevent fraud, for spam and prohibited words and may block Members or Visitors who violate our Terms and Conditions of use.

Other site members may post information about you and you may post information about other people in the Forums, TCTerms and the Hall of Fame and Shame. This information is subject to our Terms and Conditions of Use. In this case, we collect information about you supplied by other people and make it available as part of our Services. You cannot opt-out and if you do not like it, please do not use or stop using this website. For example, your clients may post information in the Hall of Fame and Shame about the quality of your job or you can post information there describing how your client helped you or paid for your service.

TranslatorsCafe.com servers log data when you use our Services, for example, pages you view, your searches and other actions. We may collect your location information from your IP address. We automatically log data even if you have not created your TranslatorsCafe.com account. We use your logon information (your user name and password), cookies, device information and IP addresses to identify you and to log your use of our services. We can use our server logs for the search engine optimization, site development, and quality assurance, network troubleshooting, customer service, investigating security issues, and to investigate and prevent fraud.

You can visit the TranslatorsCafe.com website even without telling us who you are or revealing any information about yourself. In this case, our Web server collects the URL, the IP address, the proxy server and the domain you used to access TranslatorsCafe.com, the type and version of the browser and its add-ons and operating system you are using, and the website you came from. This information is used by us to measure the number of visits, average time spent, pages viewed, and other general statistics about visitors to TranslatorsCafe.com. We may also use this data to monitor site performance for systems administration purposes, to make this site easier and more convenient to use.

We collect information about you when you post, send or receive messages using our Services. For example, if a potential client sends you a message asking for a translation of a document, we store information about this fact. However, we do not store email messages sent through our mailing system. We store messages when you use our private messaging system. They are stored on our servers until you delete them.

We also use automatic scanning technology on messages for various purposes including, for example:

• looking for specific strings that indicate emojis to render it as images.
• Looking for web links to render them as hyperlinks.
• Looking for specific words to detect spam and block visitors who are trying to send it.

Though we mostly use automated methods, occasionally we may need to manually review some communications, for example, for fraud investigation or for checking and improvement of our automated tools.

Our Services allow you to stay connected and up to date with your colleagues, partners, current and potential clients. We use data about you and provided by you to help other people find your profile. We use data provided by other Members to help you find other professionals or clients.

Data of freelance translators that we collect (business names and addresses) are mostly publicly available because freelance translators are in business and users provide them for us to publish them, that is, to make them publicly available to potential clients and to search engines. The main purpose of any translator who provides their data is to be found on the first page of the search results for translators in their language pair in various search engines. If this is not what you want, please do not create a profile on TranslatorsCafe.com.

Our services allow you to stay informed about professional topics through our Forums, TCTerms Q&A, explore careers, to seek out and be found for career opportunities. Your profile can be found by your potential clients. We will use your data to recommend posted jobs to you and your services to potential clients. Keeping your profile up-to-date and accurate may help you better connect with other people and to find more opportunities while using our Services.

We also use your data to operate, protect, improve and optimize our Services, to provide you with customer support, to detect and prevent fraud, spam, abuse and other harmful activity, to conduct investigations, to enforce our Terms and Conditions of use and other policies, to provide targeted advertising and marketing.

We sell premium membership called “Master Membership” that provide better functionality and tools. Master Members may download publicly available agency lists containing business information about agencies registered by you and other Members. These lists contain email addresses of agencies if they are not marked private by owners of agency profiles.

From time to time, TranslatorsCafe.com may contact you through notices on the website, messages to your private messaging inbox and email. We will send job, forums and TCTerms Q&A notifications as well as service, security and legal notices and updates. You can opt-out of receiving job, forums and TCTerms Q&A notifications and news, however, please be aware that you cannot opt-out of receiving service, security, and legal notifications.

Our mailing and private messaging systems also enable communications between you and other Members, for example, messages inviting you to join a group or messages from potential clients.

TranslatorsCafe.com targets ads to Members and Visitors directly and through participation in Google AdSense where Google operates as a controller. We use data provided by members (working languages and location) and information provided by users’ browsers (languages) to serve ads to our users. Google serves ads using information from the page on which ads are displayed if this page is visible to Visitors. Information on how Google uses data when you use Google partners’ sites or apps (including our services because TC acts as a publisher for Google AdSense ads) can be found on Google Privacy page.

We use all collected data including your communications to investigate, respond and resolve various issues, for example, bugs, complaints, spam and phishing attempts, security issues, possible fraud and possible attempts to harm our Members and Visitors.

Your profile with all information supplied by you is fully visible to all Members and Visitors unless you limited access to it by choosing not to show your profile or your contact information. You can also disallow indexing your profile by search engines by selecting the corresponding check box. While well-behaved search engines will not index the content of your profile, they may still index it if they find it elsewhere. Therefore, to entirely prevent your information from being added to the index of search engines, do not publish information about yourself.

You can post messages, like or dislike messages posted by others, comment on them, ask and answer questions on the TC website. All this information provided by you will be publicly shared and visible to Members and Visitors. This includes your name, your mother tongue, your working language pairs, your photo or logo if you posted one in your profile. Some posts are visible only to certain Members, for example, messages in the Hall of Fame and Shame are visible only to paying and active TC members and Members about whom you posted a message, and messages posted in a group are visible only to group members.

When you post a message, we let other Members know about this fact.

We use payment processors PayPal, Elavon, Skrill, and TD Bank to process your payment for various TC Services. They will have access to your data as necessary to process your payment and are obliged not to disclose it or to use for purposes other than payment processing.

We will share your personal information with organizations or individuals if we have a good-faith belief that access to this information is reasonably necessary to meet any legal process or enforceable government request, to detect or prevent fraud and security issues, to protect against harm our users, us or the public. We will attempt to notify Members about such legal demands if this notifying is not prohibited by law or court order.

If ANVICA Software Development is involved in a merger, acquisition or sale, we reserve the right to transfer the information that we have collected from you to the merger or sale entity as part of the change of control and we will continue to ensure the confidentiality of your personal information and notify you before your information becomes subject to a different privacy policy.

You do not need to set up an account with us to use the TranslatorsCafe.com website as a Visitor if you do not want to share your personal information with us. For example, the TC Unit Converter part of our website is fully functional for Visitors. Or you can read questions and answer or the forum discussions without registration. However, many parts of the TC website are not fully functional without creating an account.

We securely keep your personal data while your account is not closed to provide you our Services. We keep your data even if you use our website only once in every few years.

You have many choices about how to use, share, correct or delete your data in your profile, your posts, and messages. You can ask us for a copy of your personal data in machine-readable form. You can ask us to stop or limit using your personal data and we will stop using it if we have no legal right to keep using it. You can change or correct your personal data by means of editing and updating it. You can also delete your data or ask us to delete your data.

When your account is closed, it is no longer viewable. For up to 30 days after deactivation, it is still possible to restore your account if it was accidentally or wrongfully deactivated. After 30 days, we begin the process of deleting your account from our systems, which can take up to a month. Your profile will continue to be displayed on other websites and services, for example, in the search engines results, until they refresh their cache. We cannot control information about you that other people or bots copied and displayed on their websites.

We will retain your personal data after you have closed your account if it is reasonably necessary to comply with our legal obligations, for example, law enforcement requests, to resolve disputes, prevent fraud or fulfil your requests that you may file with us after closing your account. We will retain de-personalized information about you after your account with us has been closed.

The information you have posted or shared with others (messages, group posts, questions, answers) will remain visible to other Members and Visitors and instead of your name we will show “Unknown User”.

We use many administrative, technical (such as intrusion detection system), software (such as HTTPS ) and physical security features (such as keeping our servers in a secure data centre) and monitor our system for possible vulnerabilities and malicious attacks. However, we cannot ensure or warrant that your data may not be accessed, altered, disclosed or destroyed by breach of any of our physical or technical safeguards. In case of such a data incident, we will notify you after having become aware of it. If you are a user residing in the EEA, we will also notify supervisory authorities not later than 72 hours. This notification will not be considered as an acknowledgement by TranslatorsCafe.com of any fault or liability with respect to the data incident.

We process your personal data only on our servers in a secure Canadian data centre. The percentage of Canadian users is less than 2%, therefore, for the majority of our users, we store your data outside of your country of residence. Because TranslatorsCafe.com website operates globally, we may make information we gather available to worldwide partners. By providing any data on the TC website, you express your consent to such transfers of your data to Canada, the USA, and other countries.

We process your personal information for the following legitimate purposes:

• To enable us, Members and Visitors to conduct business, to connect with each other offer their services or find service providers, find jobs, express opinions, ask and answer questions and exchange information.
• To improve our website and customer relations.
