I hear you, Matthias, although my input was rather to point to another fact (and admittedly on a broader level).  Namely, that such concepts are an attempt 1) to disjoin the contractual relationship between the agency (or in this case the marketplace - and yes, the term "Marktplatz" can be found in their FAQ section) and the translator and 2) to make translators accountable towards the end client.

IOW, this outfit can claim that "We will not pay you as the end client was not satisfied", but by giving a rather new meaning to this outworn statement/excuse as they ask for advance payment.  I am only pointing to this as similar attempts were made in France, quite with the same results - and ended with the marketplace in question entering receivership, if not worse.

It is also worth reading the passage bearing the title Was passiert im Fall einer Reklamation? (also in the FAQ section).  Although translators can be given the possibility to correct "mistakes" (a), I wonder whether this possibility will be used at all given the current state of the "market".  And this opens the door to quite a wide spectrum of doubts and interpretations.

(a) A possibility is clearly not an obligation...

Can someone provide a link?  I still can't find it in the HFS.  Without knowing which agency or organization it's about, it is hard to know what to look for.

Thank you, Laurent.  I do remember reading that one when it came out. The original post did not say exactly the same thing, it has been altered.  That makes it almost impossible to help.

From the point of view of company law, a "Marketplace" on the Web is just another company (GmbH) and so they purchase and take orders under the same legal conditions as any other company.

Some agencies have attempted to liberalise the contractual situation and make it easier to have people working for less money.

Calling an outsourcing website a Marketplace is apparently just a trading style with no real legal difference. The difference it makes is in juxtaposition to a traditional translation agency (concerning in-house features etc.).

Such Marketplace concepts rely on automatisation of most of the ordering and billing procedures through  eCommerce solutions - it is apparently the old Tim Ferris 4h/w dream, making lots of money via the Web with other people's products and services.

A marketplace has the requirement that the SP meets the clients and contracts directly with them. This was experimented on translatorscorner.com but it was apparently not very successful - it is not the least reason for the clients to use agencies for confidentiality reasons and so they do not really want to meet the SP at all.

In Germany most eCommerces use the same standard Terms.

I wonder if such specific formulations in Term are applicable at all from the legal point of view.

I had to alter the posting as I was blackmailed by the company manager to take the full posting away.

So I just updated it with the comment that I was blackmailed to delete the posting from TC.

The company manager does not have the right to demand HFS feedbacks be deleted as he agreed to TC Terms and Conditions (they are signed up).
